"Under what circumstances should Internet Service Providers (ISPs) be held liable when copyrighted material is made available over the Internet without authorization of rights holders? Is Google's controversial Library Project to scan millions of books into digital format an ambitious plan for public good or is it just another format of copyright infringement under the digital age? When audience enjoys watching live broadcasts of sports events, who are the rights holders behind the scene, and how do they protect their rights and interests from being infringed? All these questions have become highly important under the digital age, and therefore drawn serious attention from legal scholars and legislators worldwide. For direction, the world looks to influential legal regimes arising from the U.S. copyright law, the EU Directives, along with the jurisprudence and legal theory that attaches to each. But the world also looks to China, where a rapidly evolving legal regime holds its own course. This very useful book compares the legislation and case law of Chinese copyright law with those of the United States and European countries, focusing on three subjects - the liability of Internet Service Providers, the 'fair use' versus 'fair dealing' copyright doctrine, and the copyrightability of live sports telecasts - all of which are unsettled questions of law under the existing copyright regime"--P. The book’s very useful information includes such items as the following: detailed comparisons with European e-commerce regulation; business models for operating a website in China; Chinese rules on online purchase contracts, privacy, and data security; downloading and distributing software and other material; protection against copyright infringements and computer fraud; issues of jurisdiction and governing law; advertising and “spam”; use of “cookies” in online marketing; taxation of e-commerce; existing gateways for online payment; effect of the expansion of the so-called social forums; understanding Chinese online consumers and their behavior; importance of Chinese culture and heritage when applying copyright on the Internet; and progress towards a freer and more secure cyberspace in China. An appendix presents English texts of essential Chinese legislation affecting e-commerce. As a full-fledged definition of this new channel of distribution, its boundaries and functioning, with a particular focus on China, this book is an indispensable source of guidance and reference for counsel representing global marketers at any level of business. Its importance for scholars and researchers in the critical field of data security goes without saying. However, this book is also a guide for all the enterprises wishing to do business in the online dimension in China, and for all the consumers shopping online, wishing to know what their rights are when buying products or services on the Internet, and to know how to protect themselves if something goes wrong.

Since the mid-2000s, public opinion and debate in China have become increasingly common and consequential, despite the ongoing censorship of speech and regulation of civil society. How did this happen? In The Contentious Public Sphere, Ya-Wen Lei shows how the Chinese state drew on law, the media, and the Internet to further an authoritarian project of modernization, but in so doing, inadvertently created a nationwide public sphere in China—one the state must now endeavor to control. Lei examines the influence this unruly sphere has had on Chinese politics and the ways that the state has responded. Using interviews, newspaper articles, online texts, official documents, and national surveys, Lei shows that the development of the public sphere in China has provided an unprecedented forum for citizens to influence the public agenda, demand accountability from the government, and organize around the concepts of law and rights. She demonstrates how citizens came to understand themselves as legal subjects, how legal and media professionals began to collaborate in unexpected ways, and how existing conditions of political and economic fragmentation created unintended opportunities for political critique, particularly with the rise of the Internet. The emergence of this public sphere—and its uncertain future—is a pressing issue with important implications for the political prospects of the Chinese people. Investigating how individuals learn to use public discourse to influence politics, The Contentious Public Sphere offers new possibilities for thinking about the transformation of state-society relations.

Seminar paper from the year 2010 in the subject Business economics - Marketing, Corporate Communication, CRM, Market Research, Social Media, grade: 1.3, Cologne University of Applied Sciences (Faculty for Economics and Business Administration), course: Export Management and International Marketing, language: English, abstract: Nowadays Internet is not only used at work, but more and more at home. As a utility for private life its value is increasing significantly since Chinese netizens (a portmanteau of Internet and citizen) have explored a new source for information, merchandizing and social communities. But along with this luxurious way of communication comes an option for the Chinese government to control its inhabitants wherever they move. Netizens have to take care of their behavior, as well as domestic or foreign companies when accessing the Internet in China. In the following chapters potential threats of failure which companies might be confronted with are analyzed in order to find a sustainable solution not to miss the access to one of the most prospective markets.
