A story about arriving, belonging and finding home. As a violent civil war rages back home, teenaged Alem and his father are in a B&B in Berkshire. It's his best holiday ever. The next morning his father is gone. He's left a note explaining that his parents want to protect Alem from the war. This strange grey country is now his home. On his own, and in the hands of the social services and the Refugee Council, he lives from letter to letter, waiting to hear something from his Father. Then Alem meets car-obsessed Mustapha, the lovely 'out of your league' Ruth and dangerous Sweeney -- 'no nickname. It doesn't get shortened'; three unexpected allies who spur him on as Alem fights to be seen as more than just the Refugee Boy.

The Making of the Modern Refugee is a comprehensive history of global population displacement in the twentieth century. It takes a new approach to the subject, exploring its causes, consequences, and meanings. History, the author shows, provides important clues to understanding how the idea of refugees as a 'problem' embedded itself in the minds of policy-makers and the public, and poses a series of fundamental questions about the nature of enforced migration and how it has shaped society throughout the twentieth century across a broad geographical area - from Europe and the Middle East to South Asia, South-East Asia, and sub-Saharan Africa. Wars, revolutions, and state formation are invoked as the main causal explanations of displacement, and are considered alongside the emergence of a twentieth-century refugee regime linking governmental practices, professional expertise, and humanitarian relief efforts. This new study rests upon scholarship from several disciplines and draws extensively upon oral testimony, eye-witness accounts, and film, as well as unpublished source material in the archives of governments, international organisations, and non-governmental organisations. The Making of the Modern Refugee explores the significance that refugees attached to the places they left behind, to their journeys, and to their destinations - in short, how refugees helped to interpret and fashion their own history.

Nine years have passed since the ethnic conflict ended in Sri Lanka. The hope that Sri Lankan refugees would return to the island has been belied. This book highlights the dilemma faced by the Sri Lankan Tamil refugees in the context of the twists and turns in Indo-Sri Lanka relations. The global refugee phenomenon and the Indian experience, the movement of Sri Lankan refugees to different parts of the world, the rise and fall of the Tamil Tigers and the competitive nature of Sinhala politics which stands in the way of ethnic reconciliation are analysed in detail. The peculiar problems faced by refugees of Indian origin are highlighted. The Author makes a plea for the enactment of a National Refugee Law, which should combine the humanitarian concerns of the refugees and security interests of the Indian State.

This book considers the United Nations High Commissioner for Refugees' contribution to international refugee law since the establishment of UNHCR by the United Nations General Assembly in 1951. The book explores the historical and statutory foundations that create an indelible link between UNHCR and international refugee law. This book charts the significant evolution that has occurred in the organisation's role throughout the last sixty years, looking at both the formal means by which UNHCR's mandate may be modified, and the techniques UNHCR has used to facilitate the changes in its role, thereby revealing a significant evolution in the organisation's role since the onset of the crisis in refugee protection in the 1980's. UNHCR, itself, has demonstrated its organizational autonomy as the primary agent for the adaptation of its responsibilities and work related to international refugee law. The author does suggest however that UNHCR needs to continue to extend and strengthen its role related to international refugee law if UNHCR is to ensure a stronger legal framework for the protection of refugees as well as a fuller respect for refugees' rights in practice. UNHCR and International Refugee Law should be of particular interest to refugee lawyers as well as academics and students of refugee law and international law, and anyone concerned with the important role that UNHCR plays in the protection of refugees today.

Sixty years on from the signing of the Refugee Convention, forced migration and refugee movements continue to raise global concerns for hosting states and regions, for countries of origin, for humanitarian organisations on the ground, and, of course, for the refugee. This edited volume is framed around two themes which go to the core of contemporary ‘refugeehood’: protection and identity. It analyses how the issue of refugee identity is shaped by and responds to the legal regime of refugee protection in contemporary times. The book investigates the premise that there is a narrowing of protection space in many countries and many highly visible incidents of refoulement. It argues that ‘Protection’, which is a core focus of the Refugee Convention, appears to be under threat, as there are many gaps and inconsistencies in practice. Contributors to the volume, who include Erika Feller, Elspeth Guild, Hélène Lambert and Roger Zetter, look at the relevant issues from the perspective of a number of different disciplines including law, politics, sociology, and anthropology. The chapters examine the link between identity and protection as a basis for understanding how the Refugee Convention has been and is being applied in policy and practice. The situation in a number of jurisdictions and regions in Europe, North America, South East Asia, Africa and the Middle East is explored in order to ask the question does jurisprudence under the Refugee Convention need better coordination and how successful is oversight of the Convention?

This book examines the link between refugee protection, duration of risk and residency rights. It focuses on two main issues of importance to current state practice: the use of temporary forms of refugee status and residency and the legal criteria for cessation of refugee status under Article 1C(5) of the 1951 Refugee Convention. In analysing this issue, this book canvasses debates which are pertinent to many other contentious areas of refugee law, including the relationship between the refugee definition and complementary protection, application of the Refugee Convention in situations of armed conflict, and the role of non-state bodies as actors of protection. It also illustrates some of the central problems with the way in which the 1951 Refugee Convention is implemented domestically in key asylum host states. The arguments put forward in this book have particular significance for the return of asylum seekers and refugees to situations of ongoing conflict and post-conflict situations and is therefore highly pertinent to the future development of international refugee law.

Two unaccompanied children travel across the Mediterranean in an overcrowded boat that has been designed to only make it halfway across… A 63-year-old man is woken one morning by border officers ‘acting on a tip-off’ and, despite having paid taxes for 28 years, is suddenly cast into the detention system with no obvious means of escape… An orphan whose entire life has been spent in slavery – first on a Ghanaian farm, then as a victim of trafficking – writes to the Home Office for help, only to be rewarded with a jail sentence and indefinite detention… These are not fictions. Nor are they testimonies from some distant, brutal past, but the frighteningly common experiences of Europe’s new underclass – its refugees. While those with ‘citizenship’ enjoy basic human rights (like the right not to be detained without charge for more than 14 days), people seeking asylum can be suspended for years in Kafka-esque uncertainty. Here, poets and novelists retell the stories of individuals who have direct experience of Britain’s policy of indefinite immigration detention. Presenting their accounts anonymously, as modern day counterparts to the pilgrims’ stories in Chaucer’s Canterbury Tales, this book offers rare, intimate glimpses into otherwise untold suffering.
